The petition pursuant to PA.R.Crim.P. 790 is to be used for partial expungements as well. The petition pursuant to PA.R.Crim.P 9122(b)(3)(i) relates to the expungement of summary offenses with a guilty disposition and the applicant has been free of arrest or prosecution for five (5) years following the conviction.
